This Public Offer (hereinafter — the "Offer") is the Provider's official proposal to conclude an agreement for the provision of information services on the terms set out below. Full and unconditional acceptance (acceptance) of the terms of the Offer is deemed to be the Customer's payment for the ordered services or the start of using the service. Acceptance of the Offer means that the Customer agrees to all of its terms.
1. Terms and definitions
- Provider — the owner and administrator of the AutoNews.com.ua service, which provides services for generating vehicle history reports.
- Customer — any legally capable natural or legal person who has accepted the terms of this Offer.
- Service — the AutoNews.com.ua website and its related interfaces through which the Services are provided.
- Service (deliverable) — the generation and provision to the Customer of an electronic vehicle history report by VIN code, licence plate or lot number.
- Report — a structured result of the check containing information about the vehicle collected from open and partner sources.
2. Subject of the agreement
The Provider undertakes to provide the Customer with an information service for generating a vehicle history Report, and the Customer undertakes to accept and pay for this service under the terms of this Offer.
The Report is generated on the basis of data obtained from open registers, auction platforms, insurance companies, service stations and other available sources. The Provider acts as an aggregator of information and is not the source of the primary data.
The Report is of an informational and reference nature and is not a legal opinion, expert assessment or guarantee of the technical condition of the vehicle. The purchase decision is made by the Customer independently.
3. Procedure for providing services
- The Customer enters the vehicle identifier (VIN, licence plate or lot number) in the search field of the Service.
- The Service performs a preliminary search and reports on the availability of data and the cost of the full Report.
- The Customer pays for the selected report or package of reports.
- After payment is confirmed, the Report is generated automatically and becomes available in the Customer's personal account.
- The service is deemed to have been duly provided at the moment the Customer is granted access to the generated Report.
4. Price and payment
The cost of the Services is determined in accordance with the tariffs published on the "Tariffs and prices" page. The Provider has the right to change the tariffs; new tariffs apply to orders placed after their publication.
- Payment is made in hryvnia (UAH) through the payment systems integrated into the Service.
- The moment of payment is deemed to be the receipt of funds into the Provider's account, confirmed by the payment gateway.
- The security of payment data is ensured by a certified payment provider; the Provider does not store bank card details.
5. Rights and obligations of the parties
The Provider undertakes
- To provide the Service in the scope and within the time frame stipulated by the Offer.
- To ensure access to the generated Report in the personal account.
- To provide technical support on matters relating to the operation of the Service.
- To protect the Customer's personal data in accordance with the law.
The Customer undertakes
- To provide accurate data for generating the Report.
- To pay for the Services in accordance with the current tariffs.
- To use the received Reports only for lawful purposes.
- Not to transfer account access data to third parties.
6. Liability of the parties
The Provider is not liable for the completeness and timeliness of the information in the primary data sources. The Report is generated on the basis of information available at the time of the request and may not contain records that are absent from the relevant registers and databases.
The Provider is not liable for decisions made by the Customer on the basis of the Report, nor for losses arising from the inability to use the Service for reasons beyond the Provider's control (failures of third-party sources, actions of providers, etc.).
7. Refunds
Since the Service has the nature of digital content provided at the moment of payment, refunds are made in exceptional cases — in particular, if the Report was not generated due to a technical error of the Service. The terms and procedure for refunds are described in detail in the Refund Policy.
8. Personal data
By accepting the Offer, the Customer gives consent to the processing of their personal data to the extent necessary for the provision of the Services. The procedure for collecting, storing and using data is set out in the Privacy Policy, and the use of cookies — in the Cookie Policy.
9. Force majeure
The parties are released from liability for the full or partial failure to fulfil their obligations if it is the result of force majeure circumstances (natural disasters, military actions, decisions of the authorities, large-scale failures of the Internet network infrastructure) that arose after acceptance of the Offer.
10. Term and amendment of conditions
The Offer comes into force from the moment it is posted on the Service and is valid indefinitely until it is withdrawn by the Provider. The Provider has the right to unilaterally make changes to the Offer by publishing a new version on this page. Continued use of the Service after changes are made means the Customer's agreement to the updated terms. The rules for using the Service are additionally governed by the Terms of Use.
